Remarriage by wife how can i punish her

can a hindu married lady marry with another man without divorce. if not,what is the maximum punishment.and who will be victim .men or that lady.

Both will be liable for bigamy.. If a married women re-marry with another man during lifetime of her husband then she would be prosecuted for bigamy.
It's better that first should take divorce. For more info book appointment will discuss entire case.

Hello, no, a hindu married wife can't marry with another person without divorce. If she does, that act will be offence as bigamy or as per section 494 of IPC . And punishment in section 494, .... Extended to 7 years ... And lady will be the victim of bigamy offance.

Second marriage is nullity and is not recognised in society or by law. The man shall be liable for punishment in this case. You need to prove the second marriage and cohabitation u/s 497 of IPC.

Mere exchange of garland is not sufficient.

NeitheRr hindu man nor women can marry again, during the life time of spouse without taking divorce, his/her subsequent marriage is null and void by the operation of section 11 read with 5(1). Now come on the criminal liability part, yes she can be punished under section 494 i.p.c. you can initiate criminal pRoceedings against him, further more u can also initiate criminal proceedings agaimst the person who has enticed her. Punishment for both the offences is upto 7 & 5 years respectively, u can call me anytime on my given no.

The answer is no.
1.Second marriage is invalid if the divorce from first spouse is not obtained.
2.Its is an offence punishable under Indian Penal code.
3.The offender(woman) can be prosecuted for cheating to that other man.
4.Bigamy attracts section 494 of Ipc where the imprisonment may be extended up-to 7 years or fine or both.
5. File a divorce petition under Hindu marriage act and consult a lawyer...
