Property claim case by my sister who was negligent towards parents

05-Nov-2023 (In Family Law)
My sister was negligent towards my parents and they denied her share in property. My father died with naming me his inheritor only. He didnt wish to give any share to sister cause of her behaviour. Can she claim the property now after my parents death?

Depends whether your property is ancestral property or was acquired by your father by way of his own money also known as self acquired property. In case your property is ancestral then your sister has a case before the Court.

If it is self acquired property of your father and if your father has executed any testamentary document in your favour then your sister has no right over the same. But if your father passed away without documenting the same then as per Hindu succession act from September 2005 she has equal rights as a copacener. So you need to be more specific.

To answer this quary, you first need to tell us whether is there any will, family settlement, or any conveyence deed in your favour regarding that property, if not then surely ur sister can claim her right over the property.
