Police filed Charge sheet for having extra marital affairs

Police file a chargesheet under i.p.c.420 for extra marital affairs with other woman as a co-accused, but i am living abroad since last 14 yrs. and my wife is staying in her parental house, how this cheating charge become tenable? It may be called as a crime against the marriage but cheating (iPC sec.420), Is it really applicable? kindly answer me.

Dear sir
It is not attracted.its not that u live abroad for 14 years..and wife living parents house. Who filed this case? If the husband of the women filed it than it may be..if u have relation with that women..but in other section of Ipc..without knowing about the contents of FIR we cant advice.

If the police has already filed a charge sheet against you, then first of all it will be a GR Case. Moreover, find out the person who lodged FIR/Complaint against you. Since you are living abroad then try to prove it, it will help you to dismiss the case.
