Paternal aunt asking for share in grandfather's property what to do
22-Aug-2023 (In Family Law)
My grandfather died in 1979. My father's death happened in 2013. Now my father's sister is claiming equal right in the property . What the law says about giving equal rights to daughters in father's property. Can they claim their share now?
As per your query
Your maternal Aunt cannot claim rights in the property as her father expired prior to the amendment in Hindu Succession (Amendment) Act, 2005. If the father daughter were to claim equal rights with her male siblings the father would have had to be alive as on September 9, 2005.
