23-Jun-2023 (In Family Law)
I,myself, our mother & my younger brother are three owner of our land. There are three rooms on rent which are the only sources of my mother's independent income. Our mother is over 70 years & has been suffering from various ailments related to diabatic. All the agreements with the tenants have been done with my mother. Bt recently my younger brother is allowing only one rent for mother bt others two he is enjoying. Repeatedly i told him to allow it for mother bt he is not willing. Mother is in acute financial crisis, unable to meet her medical expenses. What can she do in this respect?

You must lodge a complaint with the local police station and also file a domestic violence case against your brother as well as your mother has every right to dismiss your brother from the joint share if he is not properly looking after her and harassing her. Detailed discussion is neccessary.

You immediately have a notice issued to all the tenant that your mother has decided not to pay the rent to else apart from her otherwise the same shall be treated as default and she has not authorised to grant any receipt on her behalf or else she can seek the rental in cheque account payee in her name instead of cash.

You all have your 3 individual right in respect to 3 rooms. U have your different share so serve legal notice to your brother to release your share of rent and room. File a police complaint also Fr illegal encroachment.
