Parents divorced can I claim my expenses from my father

My parent s were separated after a lot of dowry disturbances..but without divorce. There was a exparte divorce between my mom and dad, but my mom was unaware of it for 10 years. She recently filed a case to rule out the divorce and succeeded. But we dont stay together. Now i am 19 and want to study medical but my mom doesnot have enough finance. I asked my father for help gut he refused. So is there a way i can legally ask my father to give me finnce for further education. Also for some monthly alimony as my mother is a teacher and is retired now.

Your mother can claim maintenance under Section 24 Hindu Marriage Act , Section 125 CrPC and Section 18 Hindu Adoption and Maintenance Act. You can claim maintenance only under Section 20 Hindu Adoption and Maintenance Act since you are a Major.

Yes you can separately file petition for maintainance under ciminal procedure code to claim maintainnance from your father. That maintainnace is yoir absolute right without any fail but for medical expenses it has to proove that he has sufficient means to support you

Yes you can claim maintenance from your father as you don't have any financial assistance or source of earning. Its yours fayhers responsibility for upbringing of he cannot be mere biological father n wash off his hands from the responsibility which he has towards you and your mother. Your mother too can claim maintenance under Hindu maintenance act as well as domestic violence act.

Ofcourse in capacity of dependant, you can ask for studies. Depending how far you succeed to show Court that you deserve to be maintained for this purpose by your parents, who are living separately as broken family. Your case has merits, if details are discussed.

you can file an application for maintenance against your father and also mentioned the liability for study expenses. under section 125 cr pc you can file an application due to unable to maintain herself.
