05-Feb-2023 (In Family Law)
Hello, I'm 27 years old and sikh by religion. Married to a hindu. I was working outside country as a cabin crew. I worked for 3 years and 8 months.I use to send home all the money to my brother, we were holding joint account. But as I decided to do love marriage he started behaving weird. He himself is divorced and did love marriage, he didnt came for my wedding plus now he's refusing to return my money. He invested all the money on his name. Right now i don't have any money and i dont know what to do because according to lawyers my case is weak and I'm not going to get anything as I gave the money willingly. Kindly help me please.

No your case is not weak at all. Your brother is liable for Criminal Breach of Trust Under section 405 IPC. Now you will have to register a complaint in the nearest police station to set the criminal law in motion. Consult for further assistance.

Sir if your account was joint you can file a criminal case against your brother for cheating. As it is your money with the relevant documents it can be proved that it was your money. For further details please call eight seven six seven seven two two five three four.

What ever amount you have deposited in joint account do you have any proof for the same?
And is the account was single hand operational or you both were signatories. Where is the account?
See on the basis of these proof you can punish your brother by sending one legal notice through lawyer and then criminal breach of trust and cheating FIR can be registered.

firstly you have to proved that your brother willingly misappropriated and withdrawn all money without your consent
i think the lawyers rightly said that your case quiet weak but you can take chance by make some evidence as above i said and file complaint
