Domestic violence against sister and mental harassment also what to do

my sister married for five years n from the starting there was some minor issues in her marriage but from a year its increasing day by day. her in-laws n husband harass her mentally n some time physically also. but after some family pressure from our end he stops the physical violence. she has a child but her husband does not take care them both economically n emotionally. he asks her to take her part in our family land which we have. he always threatened her to leave after seven years so that we can not file a dowry case and so many other issues. when she was pregnant he left her in our home n we took care of her. now she is living with him but he never give her money for daily expenses. he continue torture her mentally saying he will not physically damage her so that she can not file a case of domestic violence as well. what are the legal steps we can take?

Women have been provided protection under the Domestic Violence Act. You may see it yourself by downloading the DV Act soft copy from the website. You should not wait for a longer period of time if things are going worse. File complaint under DV Act as well as take action as per Cr Pc sec 125 and 126. you may discuss the facts of your case.

You can still file a case for domestic violence seeking protection orders, monetary relief and residence order. However, final advice would depend on what does your sister want. If she wants a divorce, then filing a divorce petition would assure you monthly maintenance. If you want to pursue domestic violence, that also can be filed accordingly.

Your sister can file a complaint under protection ​of women from domestic violence. Under this act she can claim for protection, residence and maintenance. This is very good and appropriate provision for her.

Dear Greetings, You have to cautious enough regarding this. Like this she can't live all her life without any monetary help, emotional support and main suffering is for the child which needs care from both the parents. If they harass again, file a complaint with help of a lawyer so that details can be incorporated in the complaint regarding the offence committed by them. If threat is there and is persistent, you should not waste time file the divorce for a healthy and peaceful life for your sister and her child.
