You can file a fresh divorce petition against him. But you have not stated what stage that conjugal restitution case is in now. I have a devise to get a quick divorce for you if that case is still pending, or even closed.

First I want you to get maintenance order from family court since you can take action against him by filing execution petition against him by making payment if not paid jail later proceed 498a criminal case against him file domestic violence act take action against him later he will come for compromise settle issue by monetary gain take divorce

The conditions are not properly narrated. However as the query discloses that wife does not like to lead a marital life with husband without convincing reasons, may not get decree of divorce even applied. The query does not disclose as to what prompted the wife to get away or separated from husband.
Resorting to maintenance is good, but falsely implicating husband or anybody is also an offence punishable under law.
Please think seriously as to what is the compelling reason to seek divorce. Leading harmonious life is the object of entering into the matrimonial ties. So, think before ink to legal remedy of divorce. Good Luck.

Why you are making so much mess. When he has sen restitution of conjugal notice to you means he is interested to continue matrimonial life with you, anyhow after when its failed why did you sent 498 against him if your intention is taking vengeance against him means just proceed further by insisting the police to take action and make his life hell. If you want to deal intelligently take a divorce from him through mutual consent by accepting for some alimony through settlement and save your precious time. When you don't want to lead a life with that person then why you are wasting your time on him by filing several litigation.
