Marrige problem. What to do ?

Sir/madam i m married women having one child and lived with my patents aftetr deliver. My mother in laws forced my husband to live me and my son. she presserise him to left me and lives with her i will give her also legal notice but she is not rly for the notice, infect she told me that if i live with my husband she will commit succide pls give me suggest and help for that i love my husband and dont want to left him. Pls help

Madam, if because of your mother-in-law your husband has left your company, then you can initiate legal proceedings against your husband, and against your mother-in-law.

If you want to get your husband back, and all others means have been failed, then you can file a case of restitution of conjugal rights against him. And you can also file a maintenance case under section 125 of CrPC against your husband. By these two cases he will understand that it's his moral and legal duty to keep his wife and children and that he cannot leave his wife and children for his mother.

You can also file complaint against your mother-in-law and your husband, under domestic violence act and section 498A of IPC. Because not letting you live with your husband is also a kind of domestic violence and cruelty.

Don't worry .Very first you file an application to mahila thana in written .Counselor of Police station will call both the parties and will try to solve your problem.You also may file a case of domestic violence against your mother in law Before District and Session court .Besides you should file a case under section 9 as well as section 125 under Hindu marriage act in family court under the mature guidance of learned advocate

YOU MAY FILE A SUIT FOR RESTITUTION OF CONJUGAL RIGHTS UNDER THE PROVISIONS OF SECTION 9 OF THE HINDU MARRIAGE ACT, 1955, IN CASE YOU BELONG TO HINDU COMMUNITY. SIMULTANEOUSLY YOU MAY SEEK REMEDY UNDER THE PROVISIONS OF DOMESTIC VIOLENCE ACT SO ALSO SEEK MAINTENANCE UNDER SECTION 125 OF THE CRIMINAL PROCEDURE CODE, 1974

You file the domestic woilence case against your mother in law in women police station in u dist. Same time u also file section 9 hindu marriege act case before the family court .i can help u in this case
