My husband works in Air Force. After marriage on 12th day my sister in law fought with my husband and said she will file a rape case against him and ask us to leave my in laws house and We came to my mother's house with all the stuff and he went to service.Then we search for our own flat.We bought a flat jointly and now he is not paying the EMI of flat, not sending money for me and my child, not comingherefrom last 1.5 year.When my daughter born ,he didn't accept my daughter.He wanted son instead of daughter and faught. Court counselling is done.He is not listening to the counsellor as well.

If Court Counselling is going on, that means you must have already filed a DV Case against your Husband. The only possible way as of right now is that you keep a Demand before your Husband keeping in mind about your Daughter and the pending payments towards the House. You can demand a residential house as well as lumsum amount of Money for you and your Daughter. Or if the Counselling/Mediation fails, then you can just make an interim application for Maintenance of Yourself and your Daughter before the Court pending the final decision of the Case. Once the Court directs your Husband to pay Maintenance to you and your daughter, your Husband has to pay the maintenances irrespective of his wishes.
