29-Oct-2023 (In Family Law)
My Hindu Female friend during the process of divorce in court with her previous husband got attracted to a Muslim Guy and they both started live in relationship. They lived in same house and she got pregnant and gave birth to a child on June 2016 and she got divorced from her previous husband in oct 2016. Due to some problems my friend wants to live alone with her child and the muslim guy he agreed to give her monthly 7000 rs as maintenance but orally. They both are not married yet.She is in dilemma, if the guy ditched her after few months of giving her maintenance and later refused to give her maintenance then what will she do? Please help her in getting some suggestions.Thank you in advance.

She can get one time settlement amount from that muslim guy and deposit the same in bank as FD and get interest every month. As oral commitment is not valid as legal document or evidence for getting relief.

make a deed of maintenance and guardianship between both parties,
as they are not married so can not get to the court as there is no provision in law for such relation Because, she got pregnant during the wedlock with previous husband, Delivered a child from boy friend before the Order of Divorce.

If they both are mutually agreed to the maintenance agreement you can registered it at nearest place.
