Is son liable to maintain his parents

30-Aug-2023 (In Family Law)
Is there any law which says that son has to take care of his old parents(senior citizens several diseases) even though he is married and stays with wife and kid separately? After marriage, does 100% share of son's income or property goes only to wife, and there is nothing the parents get even if son is willing to share? If wife doesn't agree, can't the son keep his parents with him for 3month's or more primarily for medical needs?

Yes. Section 125 of the Code of Criminal Procedure allows dependents of a person to file a case seeking maintenance (monetary compensation). The case can be filed by parents, wife, children, unmarried/ widowed sister etc. It is a simple Complaint filed before the Magistrate's Court and the relief sought is a Court Order/ Direction to the son to make monthly payments to the parents.
