Is it possible for a family court to distribute pension b/w two wives

08-Aug-2023 (In Family Law)
We r from Hindu family. My father was govt employ, but 2 months back expired due to illness. My mother is first wife & they had 2 children myself & my sister (unmarried). My dad had another wife & a daughter (married). Now my dad's 2nd wife claiming for pension. But we r convincing her that it's not possible to grant pension for 2nd wife. Someone suggested her that it's possible in family court as both wives compromised outside court for equal proportion pension. So judge obey appeal & order to grant pension b/w 2 wives. My question is that is this possible in court & duration of trails.

Whether your father gave divorce to your mother, supposed not given divorce 2nd wife not entittle such a order.. One more thing already petition filed before family court on at the time ur father life time for grant maintenance on that time your father agreed yes she is my wife on such grounds court can grant pass interiam order.. after your father died court might be passed like such orders.. as per law 2nd wife not entitle for pension..

It's a good case to contest ,provided you are ready ,for it ,as in your case second wife is not legal but all depends how agreement has been made and what kind of compromise has been done.better suggest that you meet our seniours ,who are lawyer at SC also to help you better.
