Inter religion marriage how to get divorce

Im a muslim, i marriaed a hindu girl on 2005 at temple under hindu marriage act, plz note im not converted, we hav 2 kids too. lately due to personal reasons i asked her for a mutual divorce, she initially said okay and we filed case. just 10 days before the final day of getting divorce paper, she filed a domestic violence act against stating i was kbrutally hurting and she need maintence and lumpsom amount of 50lac. ids r staying with me, she didnt asked for kids custody till now.. i need a legal advice int his matter... I really want to knw whether this marriage is legal, any possibility she can get kids ( i meant any type of case is file for getting kids) and whether i'll hav to pay lumpsom amount and maintence..

It is not clear whether you have registered your marriage .Since you are Muslim both of you should have registered your marriage under the Special Marriage Act.Your wife is able to get the alimony from you.

In the circumstances stated, the marriage should be deemed to be covered by the Hindu Law. Anyhow, no mutual divorce is possible without her informed consent. And necessarily, you need to arrive at mutually agreed terms or seek divorce through the due process of law.
