Inheritance to ancestral property to biological mother

My husband was born in 1973.My husband's mother is a mental patient and has a share in her late father's property.His mother and father been divorced since 1978 .There was no matter of custody rights raised hence he was taken care by his father.Does my husband have any claim over his birth mother's property?if so how can he claim?

Your husband has the right to inheritance over his mother's property. Such right may not crystallise during her life time unless the property is ancestral. Any further suggestion depends on this aspect.

If his mother died intestate with out creating any document to her own property and they belongs to hindu religion then her legal heirs have right over the property after her death. If so your husband can claim share in her property.First find out the property and send legal notice and file partition suit

Hai.

Ur husband do have share right. Its time that u had fix ur share right over it. Do contact a civil lawyer of ur local jurisdiction. Ur matter can be fixed after perusing the documents and necessary documents
