You must file complaint under domestic violence act and claim monthly maintenance at your earliest since maintenance to you and child will be be granted by court only from Date of filing the petition there is high chances of getting the maintenance as your husband is Govt employee

As per matrimonial laws you have a right to demand maintenance for you and your children too. And remedy for safe your self and your children file a domestic complaint before the metropolitan magistrate of your area where you currently residing with your parents. Maintenance is your legal right and your husband has obligation to maintain you and your children if he failed to do, so you should take legal action to protect your legal rights.

You do not need to be afraid or hopeless when law provides you with enough protection. You can file a complaint against your husband and any of his family members who is guilty of causing cruelty to you before the crime against women cell and the higher authorities. Further, if you are interested to take divorce you can file an appropriate proceedings under the Hindu Marriage Act, along with an application for grant of interim maintenance. You can also proceed U/s. 125 Cr.PC for grant of maintenance if not interested to file a divorce petition.

Hi
Before I can advice you anything I will require some information from you regarding the date of your marriage, the date of birth of your children and since when are you living separately form your husband.
Also I want you to mention certain events of disputes (if possible along with dates) that have taken so far and the steps you have taken against them (if any).

No need to be afraid, you can take police assistance anytime you feel the things are getting worse and beyond your control.
