Husband tortured but never filed any case against now what can i do

Hindu but did christian marraige as huband is,can a wife enter husbands house if he restricts stating its a false MLC he didnot beat me and its a self inflicted abrasion on forehead and lower back,and as she enters he throws luggage next day and kicks her out,video is there..As i didn't file any cases to save marraige he filed null and void case to get rid of me stating a menstrual clot expelled after 1 month of marraige is of 12weeks size..i have reports that i was not pregnant at all..jus to make me wex to go around courts he filed this case..though i have proper evidence how many years will it take...STILL IF I DONT FILE 498 will court think that i am wrong,i don't have patience to go around p.s and not intensions to harm him and his family..is it necessary to file all criminal cases as i have evidence.he is an army officer and ploice are also afraid of him...time to get residence permission in his house.

U have not specified what exactly are u looking , cause if ur husband doesn't want u can not force him to live with u. Either file 498A against him so that he can compromise with u , or file divorce or section 9( Restitution of conjugal rights).

You will have to decide first as to what do you want? As your husband is not interested anymore in keeping you with him in the matrimonial home, the only recourse available to you is to approach the appropriate legal forums for getting your rights.

Ma'am, you may file an application under section 12 of the Domestic Violence Act to have accommodation and other monetary, physical and mental relief through the court of learned magistrate. You can file an FIR for the offence punishable under 498 A of IPC but it is not always necessary to file a case under the same and no disability can be attached by not filing the same.

The intention of your husband is amply clear and you are making efforts to save your marriage single handedly which can not be possible in any way. Maybe be he must have been aware. It is indeed advisable to file the cases at the earliest. Maybe be the situation may improve.
