Husband not in touch anymore married 1 year back how to proceed

05-Sep-2023 (In Family Law)
I've been married to my husband a year ago. Just got back to India after one year of our marriage to declare our wedding to his parents (dint declare earlier as they were unwell but my husband convinced everyone at my place and promised to tell his parents after a year). But they dint accept and he chose his family over me..this ain't my fault at all.. Now he's not contacting me and his family says he's not home..what should I do? I'm in the state of shock and nobody is helping me.

Hi
Hopefully you have evidences like photographs, marriage registration certificate etc as proof of your marriage.
if you have proof of both of you getting married and also that of both of you living together, you can file a complaint under 420, 405 of IPC at the nearest woman police station.
In the complaint you should also state that the parent's of your husband have not been disclosing the whereabouts of your husband after they came to know about your marriage.

In this situation personally you need to contact with any advocate so that they can give you exact guide lines to how tackle your case and how to solve your family or matrimonial problem so easily you can take an appropriate and favorable step in favor you and against your husband and in-laws.

Madam,

If you wish to continue matrimonial relationship with your husband, send a notice to him through a lawyer asking him to take you back to the matrimonial fold. If your husband is ready to cohabit with you again fine, else, file a petition for Restitution of Conjugal Rights (RCR) in the family court of jurisdiction where you are presently living. This is a formal process via which the court will send notice to your husband to appear before it and contest the case. As there will be counselling sessions in the court, there is a chance that your husband may come to terms and live with you again. However, if you want to end your relationship with your husband, file a divorce petition under Section 13 1 (1a) (cruelty) in the family court of jurisdiction where you are presently living for dissolving the marriage.
