Husband and in-laws harassing and now want divorce

1.i am 32 years old working woman .very much family matter ,and my husband was not good with me since i got married to him ,he is careless,neglect ,not loving all the time listening his mother talks and biting na scolding me na my familly . 2.Have one child now i am pregnant for anther child he fand his mother forcing me to abort and i refuse to abort and then there is an fight happened last three months back my husband had affer with one lady my mother in law also supports her so i came to know and i fought and gone to police station but not registered complete . 3.From that day both are harassing on me and they are thronging me out ,when i refuse they started biting fitting now my mother in law simply completing on me that i am biting her like that and she is saying to evrey one that every one should belive here all are one but i am alone 4.now he is telling i want diverse,but i dont want my first child is CP,and now i am pregnan every day they toucher me my husband from me

Madam in this case it is better to engage an advocate and file a domestic violence case , and ask for separate residence, take orders to be away from you and, further u can also take protection orders that they remain away from you, also take protection orders not to harass, abuse or bit you and not to force you to abort and the delivery be done in hospital of your choice, and also you can seek maintenance and litigation expenses if they are not paying you. There are other reliefs also which you can seek.

I think relation between you and your husband is strained, if there is any chance of compromise with the help of elders you can go for that and also elders can convince your hursabnd and MIL, if not come out of the house and file a maintenance case asking maintenace for you, and your children. You can also file complaint under the DV Act.

Mam i suggest you file a police complaint. That apart also file a domestic violence case asking for residence orders and to protection orders against those harassing you so that you can deliver in peace and stay at your house in peace.
That apart also seek for maintenance so that he maintains you and the child.
You will be able to get an exparte relief.

* You first lodge a complaint against your husband and your mother in law in the police station.
You can file complaint against both of them seeking for protection of yourself, your child and the one to which you are carrying. You can do so under Domestic Violence Act. You can expose your husband and make your mother in law as an accomplice in the affair your husband has, since the affair is illegal in law.
You can claim peaceful stay in matrimonial home or other place, custody of child and compensation.
You can also complain, if they are torturing you for dowry.
• If the situation does not warrant divorce, you can emphatically refuse to divorce and seek restitution of conjugal rights, if the situation is such that you either by force or on your own leave your husband’s house.
• If you are also interested in divorce-then, the matter is different. You can jointly with your husband move the court for divorce by mutual consent.
There are many other alternatives in law to seek remedies appropriate and those applicable to your situation.
