14-Mar-2023 (In Family Law)
HI. I am a citizen of New Zealand. My sons father has left me and my son here in NZ and has not paid a cent towards his living costs. Can you please advise if there is anything I can't do to get some support from the father. I have paternity papers and our 2 year court case documents for paternity. My son is now 4 years 8 months. Please advise what can be done to help me Many thanks

Hello Ma 'am, if you have the details of where the estranged/absconding father is in India and where he is working in India etc , we can certiainly file a suit for maintenance for your son and also for your maintenance. Rgds

It will be advisable to approach the matter from the child"s perspective and fight for the child's rights. The rights of children are protected and honoured under all legal systems. Tbe issue of support to the abondened spouse is something that can be addressed in the same proceedings as connected matter. However, detailed advice can be given only on study of the supporting documents and related facts. Youay contact for the same.

Hi,
You being a NZ citizen has no way to fight of file a suit in India. Thus, the laws of NZ shall apply. My advice is to hire a food counsel/advocate there and file a proper suit in accordance with the laws of NZ.
