How to take action against husband for domestic violence?

Myself got married in 2014 and from then i am struggling a lot by my harassing husband for money, sex and high possesiveness. In this three years of my married life, he beats me severely and recently he beats my parents also very severely. I don`t know how to proceed legally. please advice. I have a daughter of 2.3 years old.

There is a lot provision where you can take legally step as well as action against your husband and your in-laws if their involvement is there for that you need to meet personally to any advocate where they can give good guide lines and as per your convenient.

You can file the following cases
a) 498A at nearby women police station. Though people say it is dowry prohibition act, this section in cr.p.c applies to cruelty and harassment also OR
b) You can file a case under Domestic violence act against your husband .
Not sure whether you intend to get divorced from your husband, if so you need to file another case under divorce act as the above mentioned suits only help in getting you protection from cruelty and harassment of your husband.

You have to file criminal case against your husband first
2. And file Maintainance for ur child and collect money from him 3.you have to file DVC get protect order from court against your husband and you have to get order any property also

Madam,

Approach the police under whose jurisdiction you live and lodge a formal complaint against your husband with brief description of harassment and domestic violence activities of your husband. The police will register an FIR against your husband and issue notice to him for his appearance before them for recording his statement. Your husband may be arrested also for his cruel activities if you put pressure on the police. Thereafter, the police investigate further into the case and after completion of their investigation, they will file charge sheet in the concerned magistrate court where the trial proceedings in the case will be conducted . Apart from the above criminal action, you can also file a domestic violence case (DVC in short) against your husband. Approach a local lawyer who will assist you by filing private complaint in same magistrate court. You can pray in your complaint for many reliefs envisaged under the act viz., protection order, separate accommodation, monthly maintenance ( if you are not working), child custody and compensation from the court.
