How to get the custody of a Child for a working woman

Hi, I got married on 22nd August 2010. Problems started from 5th day of my marriage.I am a working women. I work ed in Wipro and I used to get 18k as my salary. My husband used to torture for my money.I said please buy a property under my name so that I will divine my salary for that. But he never agreed for that and made that as a complaint to my father advised to give me the comfort zone such that i can share her salary with you. But he never obliged. Having complained to my mother in law she asked my husband not to be in the marital relation until unless i com down. She tried to leak the gas stove to kill me. Never ever she had respected me and she used unparliamentary words. with so many problems like this on Feb 11th 2016 I have given birth to a baby boy. Since I have to work and make my living I am in my parents place. Hubby sent a notice to me my father and mother with false allegations. Now he want to go to court for kid In Whose favour things come out. How can I come out

You have to give reply notice to him within time , then only it will be easier to you to contest any case filed by him. You can also file a petition for reunion if u wants or also u file a petition for divorce. The choice us yourself.

What notice he caused?, whether he caused notice to obtain divorce from you? or he sent notice for restitution of conjugal rights?, further information needed from you like 1. are willing for reunion, 2. what sort of remedy you want?, 3.What is expectation in this regard.

Hello,

You can file for a divorce to ask for separation from your husband.

You can also file for a domestic violence case against your husband and his family for the various attempts that they have made to harm you.

Certainly in the given facts and circumstances the custody of the child will be given to the mother as the child is a minor. Once the child attains 18 years of age then the custody will be decided based on the 'best interest and welfare of the child' i.e who will best serve the child's emotional, educational, social and medical needs.
