How to get legal heir certificate for hindu wife after husband's death

what is the process of getting legal heir certificate for a hindu wife on her husbands death...? how many days it will take to get the same...? this is required for the registration of the property on wife's name which is alloted to husband from housing board...?

It takes nearly 4 to 5 months to obtain the certificate. Infact you can even obtain a Family Member certificate from the concerned Revenue Division by applying for the same. If the Housing board insists for you to obtain a Legal Heir Certificate then you have to approach the civil court for declaration that you are the legal heirs of the deceased husband.

To get a legal heir certificate you need to apply in the civil court of the jurisdiction where the property is situated. For the property upto 3 lakhs you can apply in junior civil judge court and from 3 lakhs to 15 lakhs in the senior civil judge court and above 15 lakhs in the chief judge court which is usually a district court.It will take 3-4 months to get the certificate. Previously, a legal heir certificate was issued by tahsilsar at MRO office but due to strict instructions from the govt not to provide the same through MRO, citizens are being directed to approach civil court for the certificate. You must file a petition before proper court which has jurisdiction for getting Legal heir certificate by showing Housing Board asone of the Parties to the Petition. You must first of all see whether your husband nominated you as nominee at the time of entering into a contract for allotting House in his name. If not you must file Petition before the court for getting legal heir certificate. You must engage an expert civil advocate for filing petition to get legal heir certificate from proper court.
