How to enforce vested interest in biological father's property

05-Jun-2023 (In Family Law)
After my biological father died , my mother got married after some years again . There is no deed of adoption in the eye of law has been done . But in my school certificates , college and in other documents my father's name is my second father's name , instead of biological father . Do I still have share in my biological father's ancestral property ? Does my mom have right to give power of attorney to anybody when we (me n my brother ) were not adults . If she does this because of some pressure or in lack of knowledge of legal advise , can I claim to get my ancestral property ?

Yes! you may file a civil suit before a civil court seeking declaration and share in property. You have a right to file a suit as u are a legimitate son born out of the said wedlock. Thanks

No one can take your right over your ancestral property by whatever means possible. And your name in the school records or that of your father does not discount the fact that He was your father. In case of any funny attempt by anyone including that of your mother ...law is by your side 100%...you will win.
PS-All this is assuming you are a Hindu.
