Sir humari sadi me 8 sal hua hai,hamare do bachhe hai,humare pati 5mahine se humare sath nahi reh rahe or talak chahte hai PR mai nahi chahti,pati ka incom 60000+hai,PR bache or apne maintanace me like mai case file Kr diya hai,Hume maintanace kitne dino me bad or kitna mil sakta hai
Dear madam as per ur case urs husband has left u and urs two child for five months.As he is forcing u for u to take divorce but ur not ready .As u have right to get maintaince from husband for urs chid .Time peroid depend upon how ur lawyer fight or argue in court .It may take 9 month - 3 Yrs .

Good morning mam maine aapke issues ko padha aap jis court me maintainance file ki hain us court se firstly aapke husband ko ek notice issue hoga or Notice issue hone ke 60 days ke andar aapko maintainance milna suru ho jayega or yadi proceeding complete ni hota hai to court aapko monthly maintainance dilate rahega or jub proceeding complete ho jayega to court jo interim order pass karegi uske accordingly aapka maintanance suru ho jayega or maintainance kitna hoga ye concerned court janha aapka suit file hai wahi decide kar sakti hai.

If you had filed maintenance against your husband under section 125 of Cr.P.C before the family court then you can file an application for interim maintenance in maintenance case you filed earlier then i think with in 2 to 3 month you can get interim maintenance and after final decision of the case your minimum maintenance shall be Rs. 20,000 to 30,000 per month.
