Harrasment on mother. What can a daughter do?

Major share of ancestral property is owned by elder brother and also share of self owned property Now my younger brother and his wife has thrown her out of house and also given in writing that she cannot take care of her as she has not given property I being a daughter can take what course of action

Your mother appears to be senior citizen and she can take all benefits under Special Act that is Maintenance and Welfare of Parents and Senior Citizens Act 2007. She can claim monthly maintenance by fling a petition before Assistant Commissioner Revenue Department.

It is really sad that the children after growing up, misuse their parents or ancestors properties for their use and selfish things and completely neglect their own parents.
As you are the daughter, you are also entilted for the equal share in the ancestral property. You can claim for partition. You mother is also entitled for the share in the property. Your mother can also approach the court under section 125 crpc for maintainance.

Mother has to file complaint before the police against second son (your younger brother) and his wife for harassment. Mother has to be taken care by all the children and more-fully sons who enjoying the properties are legally entitled to maintain her livelihood and health conditions. Parents care by the children is legally mandatory failing which she may approach the Court of law for her maintenance and claim for her share.
