02-Apr-2023 (In Family Law)
I would like to know what can I do as a daughter for my parents as they are being harassed by my brother and his wife. My parents live with my only brother and his family. House is on my dad's name. There is disgusting and very bad behaviour towards my parents. My parents are in too much pressure and in frustration fight with each other instead. My sister in law is very nasty and is the root cause. I want to help my parents as cant see them being tortured . My brother calls us and threatened us as well if we interfere. Pl help
your parents should file a complaint against his son and daughter in law stating therein all the facts and circumstances and if possible ask your father to disown his son and daughter in law. also your father can file a petition under section 125 Cr.P.C for maintenance.
Also you should consult a lawyer before filing the complaint and discuss all the facts and circumstances in detail.

Hello,
For the query you posted, I would suggest the following:
The answer to your question would come first from what you would want to do to safe guard your parents from such harassment.
You have ample options, to begin with a simple threat of disregarding your brother from the family property.
As well you can initiate a suit against them especially your sister in law under domestic violence act.
You have other similar options too.
I hope this answers your query.

Thank you for your query. It will be important to know if the harassment is only limited to verbal abuse and taunts or does it extend to physical abuse. If there is physical abuse, a complaint can be filed against them. They can also be threatened to be thrown out of the house and a Will can be drafted taking away all their rights on your father's property. You have the right to interfere in your father's matters, do not get bogged down by his threats. Report to the police if he gives any physical threat.

You have full right and obligation regarding your parents maintenance and safety, Primarily your parents should file a police complaint in Police station for domestic violence and also your father should immediately ask your brother to leave the house and once he resist in vacating the house, your father as a lawful owner of the property can file a eviction suit followed by execution.

Hi! Your brother and sister in law cannot move into the Apartment which your mother would buy. We can file a police complaint or we can also send a legal notice to them regarding the same. Let me know if you wish to proceed further with this coz I would need to know the details of the case. Thanks!
