File divorce against husband living in UAE, how to go about it

I want to get a divorce from my husband. He will not agree for a mutual divorce so I have no choice but to go for a contested one. The reason for the divorce is adultery. He even has a son from one of his affairs. I hve the birth certificate n all documents to prove this. We live in Dubai and I would like to process divorce from Mumbai. I understand that a notice has to be sent to my husband and he has to appear in court. How will he get the summons in UAE and what happens if he doesn't come to any of the hearings. We have a child n I want his custody. I'm not looking for alimony or any compensation.

It will be proper if you take paid consultancy to compensate the lawyer's stock-in-trade required to advise you. The fact you had mentioned it is not practically possible to give legal solution to ur problem.

As per public international laws at first stage you have rights to obey the law of nationality country. It seems that he disobey country law,if he fails to obey Indian laws then apply shariat law and punishment accordingly.

You have not mentioned your religion and that of your husband. Irrespective if you have enough evidence of adultery a divorce petition can be filed one sided in mumbai provided the marriage was solemnized or registered in mumbai for the Mumbai Family Court to have jusrisdiction as you both still reside abroad. Once the summons are served through the embassy/ postal address then the matter will proceed if he / his advocate fail to appear then the matter will proceed exparte.
