Father threatening to commit suicide if we leave home what should i do

24-Nov-2023 (In Family Law)
me & mother is subject to domestic violence & mental torture by my father. If we think of leaving home to get rid of this torture,he threatens us that he'll committ suicide. His behaviour is absolutely normal with other people & therefore neither me & mother can share this with anyone nor we can live with him anymore. In this situation what should we do? can we leave the house irrespective of his threatening. If me & my mother leave the house we have to go to my mother's father house. My grandparents are old now.We are also scared of the fact that my father can harm them.By blackmailing us that he will committ suicide , he can do anything he wants.how to protect ourselves?

If you think so much then you will not take any step forward. If you are facing violence in your home, you can lodge an FIR or file a complaint before DCP concerned or approach the court. You can also lodge a complaint in police stating that your father is threatening you and your mother to commit suicide. The purpose of doing this is that if your father unfortunately committed suicide or attempted to commit suicide, you and your mother will be safe from any legal consequences. All the best. Revert me.

First of all you file a police complaint in your nearest police station against your father and leave your fathers house, simultaneously you can file a case for domestic violence and maintenance u/s 125 Cr.PC against your father. if you want any further assistance then you may contact me.

No person has a right to harrass others by threatening to commit suicide. I suggest that you let people around you be aware of the situation being faced by you and your mother. This is because in the event of something bad happening, you will have witnesses to tell the police that you had no role in the abetting the suicide etc.

Secondly I'll suggest that you don't force yourself and your mother to stay at home with a person of unbalanced state of mind. You may start collecting evidences against your father like cctv cam footage of his abnormal behaviour etc and armed with that you can file a complaint with the police under domestic violence act or even Indian Penal Code. In any case, your situation is not without legal remedies. Any further clarifications are welcomed.
