Father refusing to maintain the family, what to to ?

MY FATHER IS A GOVT EMPLOYEE AND FINANCIAL STATUS IS GOOD. MY MOM IS HOUSEWIFE. BUT THE PROBLEM IS HE DON'T TAKE CARE OF US FROM CHILDHOOD I HAVE SEEN THIS. THINGS CAN'T BE SOLVED BY DISCUSSION. HE DON'T HELP US FINANCIALLY AT ALL. WHAT SHOULD WE DO? HE MENTALLY TORTURE MY MOM AND I SUSPECT HE IS HAVING AFFAIR WITH OTHER WOMAN. WHAT IF HE GIVE ALL HIS PROPERTY TO THAT OTHER WOMAN? CAN WE TAKE ANY ACTION? BUT MY MOM ISN'T WORKING.

Your mom is entitled to maintenance including son/daughter below 18 yrs of age , under sec125 of Cr.p.c.As regards Immovable property son/daughter have right in ancestral property . Your mom is entitled to alimony under Hindu marriage act as per Hindu Marriage Act and pandentilite cost .

Your mom can File a mainatainence case agaisnt your father ... and may claim for legal financial assistance through court. If not then ur mom may opt to get separated from your father and may claim for an one time alumuni i.e. one time settlement money

As i dont know the whole story and if only finance are concerned then its better to obtain an order of maintance through court Considering the standard of living. Consult a lawyer for this from your area

Firstly your mother can file a case for maintenance against your father which will help you to get financial support. She can also file case under the provision of protection of women from domestic violence act claiming right of accommodation, if there is any apprehension of accommodation problem.
Suspicion of anything wouldn't help you to prove any allegation. I advise you to consult with a local advocate so that your actual problem could be addressed. You must remember one thing you don't have any right over the property of your father except right of inheritance.
