In a given situation you and your mother can seek maintenance under section 125 Cr.p.c. you need to have proof of income of ur father, property in his name, cars, any additional income of your father from any other source. Rest consult a lawyer personally.

If you are a male & minor, certainly, you are entitled to get maintenance from your father till you attain majority, and in case you are a female, your entitlement is uptill you got married. As far as your mother is concerned, she is entitled to get maintenance on her as well as on your behalf.
For that purpose, you need to file maintenance petition in appropriate court as per your requirement and status of your father. There are other remedies also which can be suggested only after going through facts of your case.

You need to file application under section 125 CR.P.C. for maintenance in the court of CJM. Let me know where are you living and what studies you are doing. And also tell me how much is your father income and what property he holds.
