Father in law's brother claiming share over his property

Actually my Father in Law are 3 Brothers 4 Sisters, and due to some family issue my father in law is little mentaly disturbed and have one Some and 3 daughters, entire life they survived only in one Room amongst the Property of 16 Kathas. And now after the death of my Grand Father in law without his any will the middle brother with the help of his 4 Sisters and mother took the 8 kathas in his name, and now also claiming on rest property as well.

Sir, perused your query in details. The only way out to claim your share is to approach the court of law and claim partition of the property. In such a case, everyone will get a share of the property.

Hello,
What I understand from your query that your grand father-in-law died intestate (i.e. not having made a will). In that case all his legal heirs have equal rights on the property. If someone has taken some portion of the property in his name, your father-in-law can challenge that in the court. Please contact me for more detailed information.

If your grand father in law transfer some portion of property to others by executing a registered deed then your wife can not claim. For the remaining portion of property ask your wife to file a partition and injunction suit in civil court by claiming her share.
