If the person did not maintain his wife or children then the wife can ask for maintenance for herself and her children. Here in this Case, wife can entitled to get maintenance. Therefore, she can file maintenance case if she needed. No wife can entitled to get any pension benefit from her husband other than maintenance claim. If the husband being a retired person or Pension holder, then maintenance allowance can be fixed upon the monthly pension amount of said husband. Gratuity Amounts P.F Benifit etc. does not come to said maintenance allowance.
