Father brother trying to take over the property of father after death?

My father started a textile shop business with his brother 60:40 ratio..my father met with accident 2 years back and my uncle not allowing into the shop and claiming entire shop has his own and he's manhandling what rights does my dad have? my dad paying the income tax every year.how can he claim his right of ownership?

Is there any partnership agreement between your father and your uncle?
Please see in whose name the firm is registered with Government under shops and establishments act.
Also sales tax registration, income tax registration if any filed by your father will be of immense help.

with all of these documents you can file a suit demanding that the business be partitioned and also claim mesne profits for the period your father has been away from business.

If your father is having any partnership, or proof of investment in the business with his brother, and if he has any other proof to show that he is partner. As far as income tax payment, whether he is paying income tax from the business of partnership, or showing his own income. With all those proof, approach a competent court through your father, and seek appropriate relief from the court against your uncle.
