Father abusing and hitting us because our brother wants his property

My father is mentally torturing me and my sister. My brother and his wife are the reason for it. They want my father's property and hence they are provoking him to torture us so that we leave the house and they get the property. My father regularly abuses us and even hit us. This has gone to an extent that we were forced to lodge a police complaint against my dad. But his behaviour has gone worst after the complaint. He wants to kick us out of our house. Can someone out there help me with this thing. Its been around 10 years that we are going through this mess every single day.

If it's father's self acquired property he has right to throw you out of the property but he has no right to torturer or abuse anybody.If local police is not helping go to hogee officers.
But if the property is ansestors property then you have right to partition.

If the property is ancestral then you file for a partition suit and permanent injunction against your brother and his wife along with a complain to the S.D.M. concerned and if the torture includes the abuses and obscene acts then you can properly file a criminal complaint in the concerned magistrate if the police is not registering the FIr

First you should know one thing if that property in question is ancestral then nobody can take your share from you unless you waive it off but if its your father's property then legally he can give it to anybody he wishes to.... and for the police complaint you should follow it n get a FIR registered against your father under relevant provisions of law.
