Facing continuous problem after the birth of my 1 year son from wife

19-Sep-2023 (In Family Law)
I am Hindu Brahmin & chemical engineer from Bokaro, Jharkhand; working in private firm, I had arranged marriage in June 2013. The girl used to work in the Father's school but quieted working after marriage. Every thing was ok but she always used to demand money from me for their parents. On resisting she used to turn violent but she used to have emotions also for me and she convinced me for having baby. Almost after 1.5 years, we had son and she denied to live with me just after that with some excuses. Anyhow my parents convinced their parents, but they were lingering this matter and asking me to manage as I used to do before marriage, anyhow she came to my home. Soon she started pressuring for Mundan ceremony of my kid. After mundan she convinced me that she wants to go to her parents and her father took her. Now she is giving excuse of some course for not coming to me for 2 years and not ready to listen at all(tired every ways). Please let me know by law if I can bring them back.

You need to understand that law cannot compel union of broken relationship. After all, it's all about one's passion to lead a happy life. However, one can file restitution. In what way it helps!

yes you can bring them back legally. You can issue legal notice through an advocate or in person calling her to come back with ur son for restitution. After 15 days file petition for restitution of conjugal rights u/s 9 of Hindu marriage act before family court of jurisdiction in places where marriage held or where u both lived or where she resides now. Prior notice is not mandatory, but it may give u fruitful result before even moving to court. It's Ur option. In the restitution petition u should disclose all the fact and reason for the 2 yr dessertion of ur wife, it may help you for future petitions. After numbering, counselling will be held for u and ur wife for reunion for the first 3 hearings. If it fails, then Ur case will proceed for counter.
