Execution of pronote decree on legal heirs

02-Mar-2023 (In Family Law)

Pronote Suit was initiated and decree was passed against legal heirs of deceased. But the legal heirs did not inherit any property from the deceased. But they received the life insurance benefits of the deceased. Now will they be liable to pay the decree amount from their personal property. They have received the insurance 3 years ago. Will the exception under 60(KB) of cpc work for them. Kindly suggest me in this regard. Thank you

No. The pronote suit amongst the legal heirs of deceased cannot be executed at all. In the event of legal heirs not receiving any property from the deceased, then they are not liable for any amount. Whatsoever is the amount received through life insurance cannot be attached. only the properties so received from the deceased is attached.
