Draftig an agreement while property purchase to avoid future disputes
08-Oct-2023 (In Family Law)
I am a Hindu Jain intending to buy a property wherein my husband will contribute 75% and i will contribute 25%. We intend to also include our son as a co-owner in the agreement to avoid the future issues of succession caused by society regarding obtaining the succession certificate etc from the court. But we also want to make sure that legally as of now he has no ownership since in case of his marriage being ended and a claim of alimony being made by his wife, we want to make sure that the claim doesnot include a claim on this property just because his name is included in the agreement. How do I go about drafting the agreement with the builder? or should we merely make an MoU between the 3 of us stating my son has no claim on ownership of the property till either of us are alive?
yes ofcourse
in agreement vendor and purchaser ( jointly purxhased the property) in case one of purchaser is minor through his natural guardian or parents behalf of signed . u specifically mention in agreement what is the share of co-owners...
1. husband
2. wife
3. minor child name
through his natural guardian and parent i.e. father/mother/both
and in case property planning to sale whether the person is minor at the time sale. he is not major. court permission is necessary.

MOU does not serve your purpose. U need to make the will of that property in favour of three of yours only. While drafting will u make it i such way that it can't be claimed by any body e except three of yours.
hello, i have been through your query and yes you can add your son as the coowner of the said property if he is major and also a draft has to be made in a different way if he is minor that depends upon the lawyer who will make your draft!
