Does both sons have equal rights in fathers property ?

Does both sons have equal rights in fathers property ? First son is a divorce having a boy and second son is married having a boy. My father got the land from my grand father during the time of partition and it is not an ancestral property.

yes both sons have equal right in the fathers property.as per the law all children will have equal right over inherited property.you can file a partition suit and claim your share in the same but you get only after fathers death.

why this question is being repeated again and again. Answer has already been given that children have no claim or right during the lifetime of the father. They have equal right on the property left intestate after his lifetime.
