Does anticipatory bail applies in the case of NCR

My wife had filed an FIR and we got it quashed in High Court after compromise. However, we again had differences and i sent her back to her maternal home. Now she has approached the police and filed a complaint against me and instead of a FIR they have registered an NCR. Can i apply for anticipatory bail?What are the chances that i will get bail since there was already an FIR on me? Will the Police get any intimation that i have applied for anticipatory bail?

What is NCR in police?

NCR is a Non-Cognizable report. It is the exact opposite of a FIR. Police are not empowered to investigate these complaints. These complaints usually involve abuse, threats and assaults with hands/kicks. They also include pushing, simple injury, etc.

Sir if it is NCR case then you cannot be arrested by police without permission of magistrate, further normally the offence are bailable hence you can get bail easily no problem, so only in non bailable cases you can apply for non bailable case.

No, you need not apply for anticipatory bail. Mere issuance of NCR does not give rise right to police to arrest you. Since you have already compromised there is no need to worry. FIR already quashed by High Court thus you are protected.

Hi
Your case sounds to be a second round of conflict between husband and wife. NCR means Non cognisable case. Police cannot arrest without warrant. First they have to issue summons then enquiry and you will have time to take regular bail.
So anticipatory bail not required.
