Do i need to pay fee for the advocate that wife hired to file 498a

My spouse filed false 498 a case against me and my family so do we need to pay her advocate fee for fighting the case ? If yes may I know how much it can be appropriately? ? Do we needs to pay even she works also ??

You do not have to pay for her advocate's fee. After the end of the matter, while dictating the judgment, the court might direct you to pay to her the cost of litigation, if she is successful. That cost is mostly not greater than Rs. 15,000. I would require to know the specific facts of the case to suggest the further course of action.

You need not pay fees of your spouse advocate in 498-A IPC case. However, as per the judgment of Delhi High Court is case titiles as Kushum Sharma vs Mahinder Sharma, Courts have the power to ask you to pay litigation expenses in maintenance cases. But if she is gainfully employed or having income, she is not entitled for any amount either for maintenance or for litigation expenses.

Since your wife will be a complainant in the case so she is not required to hire a lawyer becoz her case will be presented by the public prosecutor in the court...but certainly she can hire a private lawyerbfor herself and u will not ne required to pay for him
