Division of Grandfather's ancestral property to grandson

08-Jan-2023 (In Family Law)
Hi Can you please suggest me on the below. My grandfather had 50 acres of land and he has now passed away. The property is not self acquired by my grand father. But it has been divided to his sons -4 when he was alive. But this was not done correctly. As a grandson can I now fight to get the property disturbed equally for all grandsons. And one of his son has already sold the property which has been given to him. Please advise. Thanks

Your father got his share or not, If yes, it is properly distributed by your grandfather, legally, If the property is in ur gf's name he has every right distribute the property as his wish, legally ur father /mother has one share in ur grand father's property

Hi
If the property is ancestral then the only way the children of grand father to come in to ownership of shares is through registered partition deed.
Now only your father can challenge the partition and he has to do it with in 3 years from the date of partition
Once partition is effected, the property loses its ancestral nature and becomes an absolute property of each of the successor.
