dispute to handover my house.

HINDU - I have a house in , which is Hypo from SBI - one of my sister in law took the key from promoter, and use latrine, bathroom, water, I stay out-side, she is not willing to keep a tenent in my room 8 years long. Can I shout a file against her. and claim rent and maint. charges as per norms.

My first question to you on whose permission at the first instance did your sister in law take the keys from the promoter to use your house. I suppose you have consented her. If you have not ask her politely to leave the premises if she fails you can send her a notice and to charge rent from her you need to make an agreement such leave and license agreement to obtain rent.

The story is not clear. Whether you have house which is under Hypo under SBI then how the Promoter give the key to another person except you. It may be either you did not take possession from the Promoter or you take possession then hand over it to your said relative. In both situation subject matter will be change and relief will be different. So, put your story as clear as possible.

Your query is improper as without your consent how your sister in law can get the key from the promoter of the flat which is owned by you. If she has done so without your consent than please intimate your grievance to the promoter stating that how he has handed over the keys to your sister in law and than file a case against the promoter for playing dishonesty in the appropriate forum of law also making a necessary party to your sister in law also. Take advise accordingly with the advocate of your choice.
