Dispute between family for property after father died

Its around 5 yrs that we r fighting in court for property my mother is fighting awid their inlaws after my father died.. I m a single child of my parents and married bt staying wid my mother in the same resident for which we r fighting.

The court will decide the same if the petition file is that of a partition. According to the Hindu Succession Act, If a person does inestate then the property will be transferred and divided equally among his wife and other legal heirs, i.e, his son/daughter in case of self acquired property. In case of ancestral property, if the partition is still not done then you can file a case for partition in jurisdictional civil court claiming your share in the said ancestral property. You will them get the share on the ancestral property after obtaining legal heir certificate from the office of the Tehsildar/court and then apply for partition.
