Consequences if i have not received summons from court

498a was filed and a1 got remand. Chargesheet was filed on A1 and A2. But during the appearance at court only A1 attending the appearance and A2 is absent since summons go him is pending... My question is what may be the reason for pending of summons and if same continuous will A2 be free from all these trials since he didn't get summons...

Hello sir in police once trial commenced summons will be issued to all the accused and in case some accused living in out of station and unable to serve the summons Mena's court will intimate to serve soon .

Absolutely not. A2 won't be freed from charge unless he appear before court. A1 A2 both should appear before court, get copies of charge sheet and the court will read the charges against them and will question them whether they plead guilty or to proceed with the trial. Pending of summons may be due to non service of summons to the said person.

A2 will not be exempted. It' the duty of the police to serve summons. Check with your lawyer and he may get the details for you.
