Child's right to property of biological father

20-May-2023 (In Family Law)
My parents were divorced soon after I was born and my biological father did not contest for custody, thus, I grew up with my mother. I am 21 years old now and both my biological parents have remarried. My biological father has an offspring from his second marriage. Keeping this scenario in mind, can I, as his first born, demand for any kind of property rights or right to his assets? Can I send him some kid of legal notice regarding the same? If yes, would he be obligated to follow through with the proceedings?

Whether you biological father demaned for ur custody. As according to u ur biological parents got divorced soon after u were born . The most important point of law is this you were born becoz of such legitimate web lock. Therefore ur right to demand property from your biological father is lawful. Unless and otherwise you are disowned or deprived by way of will. In either cases u got to move before the court of law for justice. For further help feel free to contact me.

you didn't mentioned your sex. if you are a male then answer of your question is no. you have already attained the age of majority. You had a right to claim maintenance during the period of your minority. if you are a girl and till unmarried and non earning you have a right to get maintenance from your father. A further right would be created if your father died intestated leaving some properties. If, he settle his property before his death by depriving you then you would got nothing.

You have each and every right being a legitimate son upon the property of the father. But it is after the death of the father. During the life time of Father a son only can use father's name only and after the death of father, son's right can be generated over the father's movable and immovable property and also over the death benefit also.
