Case for maintenance against a govt. employee

Hello sir, im a housewife and my husband is a govt. employee. I have two children in our 28 years of married life. My husband has been harassing me and my children mentally, physically and financially for more than 9 years and now he left us and went to his new house which was brought us few months back. After many incidents i have took a decision to file a maintenance and domestic against my husband and some of his family members. I have a girl child who is ready for getting married and i have a son who have completed his education and searching for a job. Sir, please suggest me what are the sections that can be filed against him so that we can live with some piece without him. We hope that somebody like can help us, please help us.. Thank You.
as your husband deserted you and your children. you can file both maintenance case and domestic violence case against your husband and some other persons who have harassed u.

It is too late to take action for maintenance. Maintenance petition you can file in family court without further delay because after filing it takes some time to award. So interim maintenance you can seek with the help of your advocate. Secondly you can approach his office for remedial measures but takes little effort form his office required. If he is really harassing then you can file 498A. If you do not have sufficient strength to fight then you can approach Women protection cell in your area.

since your son is major, and he is searching for a job. He cannot get any maintenance from your husband. Your girl child is persuing studies. She is unmarried. So you and your daughter can claim maintenance from your husband U/s. 125 Cr.P.C. Moreover you can also file DVC case against your husband and a case for harassment and torture by your husband U/s. 498-A IPC separately. You can also claim maintenance in DVC also, and also claim rents for your home where you are staying, if it is rented one, by furnishing the proof of rent so paid.
