Can my husband take our daughter with him if I have her custody

14-Mar-2023 (In Family Law)
I am a Roman Catholic. I have the legal custody of my minor daughter. My ex husband had filed for a paternity case to prove that the child was not his, we conducted a DNA test at CDFD Hyderabad, which proved that the child is his but he is still pursuing the case. Now my question is this that, if i want to go abroad leaving my child with my parents can he come and take my child with him?

No he can not even if he is the Father but for that purpose you will have to file a case in the family court claiming the custody of your child after the divorce. If the Family court rules in your favour then your ex husband is not entitled to take your daughter from your parent's house and if he does so then you can file a complaint in the police station under section 361 of IPC.
