Can mentally challenged people claim maintenance from family

I am having issues with my family who refuse to take my responsibility as I am 36 years old and mentally disabled with no income.My father and brother regularly harass and abuse me to leave home .I have lodged a complaint with the local police regarding this and want to know what to do next?

It seems that you are able to place your problem. Even you said that you have filed complaint with police. So You can file Case seeking reliefs under domestic violence act, 2005 in the court of metropolitan magistrate or civil judge judicial magistrate for protection, maintenance, shared household and injunction not to dispossess you from the house.

Hi, You can contact the nearest Protection officer and he would fill the necessary forms and file your matter in the Court for appropriate reliefs and assist in applying for free legal aid .Ask hin to fill form III for interim releifs ,depending on the kind of mental disability he will guide you whether you need a gaurdian to represent you for the matter.

You will get maintenance from your family member only when you were unable to maintain yourself. Once you get major sound mind then you are not eligible to get any kind of maintenance. Thanks and best luck
